1. Introduction and Effectiveness of the General Conditions
These general conditions of sale (hereinafter, “General Conditions”) regulate the purchase of products and services made remotely and available through the internet network from the site https://www.spbshop.it/ (hereinafter, the “Site”) in compliance with the Italian legislation referred to in Legislative Decree 206/2005 and subsequent amendments and additions (hereinafter, “Consumer Code”). The seller of the products and owner of the Site is SPB shop located at Via Della Prava, 12, 21010, Cardano Al Campo VA. VAT number: 00270570120.
The consumer who accesses the Site to make purchases (hereinafter “Customer”) is required, before sending the order, to carefully read these General Conditions, which have been made available on the Site and which will be consultable by the Customer at any time through the link contained in the confirmation email of each order to allow reproduction and storage.
2. Choosing and Ordering Products
The characteristics and price of the various products on sale on the Site (hereinafter “Product” or “Products”) are shown on the page relating to each Product.
To purchase the Products, the Customer must complete and send the order form in electronic format, following the instructions on the Site. The Customer must add the Product to the “Cart”, then enter the shipping and any billing information, choose the desired payment method, and confirm the order after having reviewed the General Conditions and the Privacy Policy and confirmed their acceptance.
By submitting the order from the Site, which has the value of a contractual proposal, the Customer acknowledges and declares that they have read all the information provided to them during the purchase procedure and fully accept these General Conditions and the terms of payment.
The contract concluded between SPB shop and the Customer is considered concluded with the acceptance of the order by SPB shop. This acceptance is communicated to the Customer through an email confirming the order itself, containing a reference to these General Conditions, the order number, shipping and billing information, the list of Products ordered with their essential characteristics, and the total price, including any shipping costs. The Customer will check the confirmation email, and if they identify errors in the order, they will have 3 hours from the receipt of this email to contact Customer Service directly from the Site using the appropriate contact form accessible via the “Support Area” or by writing an email to info@spb.it. After this period, the order will be processed for shipment, and no further changes will be accepted, without prejudice to the Customer’s rights under article 7.
Once the order is received, SPB shop will check the stock availability for order fulfillment. If one or more Products are not available, SPB shop Customer Service will promptly notify the Customer via email, who will have 12 hours to respond to confirm the shipment of any additional available Products or cancel it. If there is no response within this period, the order will be considered confirmed, and the available Products will be shipped. If only a few Products are out of stock, SPB shop will fulfill the order with the available Products. In both cases, the amount for the unavailable Products will be immediately refunded according to the chosen payment method.
3. Product Information
The information and characteristics related to the Products are available, along with the relevant Product codes, on the Site.
The visual representation of the Products on the Site, if available, usually corresponds to the photographic image accompanying the descriptive sheet. It is understood that the image of the Products themselves is for sale presentation purposes and may not perfectly represent their characteristics and quality, but may differ in color and size. In the event of a discrepancy between the image and the written product sheet, the code on the product sheet and the one on the product box will always prevail, as the manufacturers of the products continuously update the appearance of the packaging.
- Coupon Codes – Promotions – Gifts
SPB shop may include discount coupons inside packages, send them via email, or through partner sites that can be used by the indicated date on the coupon itself. The discount coupon must be entered on the cart page within the “discount code” box and activated via the “apply code” button. The system will update the total order amount, net of the coupon value.
4. The use of the coupon is governed by the following terms of use:
- Coupons are not cumulative with other commercial initiatives;
- Coupons have a predefined value or are in the form of a percentage discount;
- They have an expiration date indicated on the coupon itself;
- The coupon does not give the right to change, will not be refunded, in whole or in part, and must be used by the expiration date. The voucher cannot be resold;
- The coupon can only be used for online product purchases;
- For fixed-amount coupon codes, if the nominal value is insufficient to cover the order amount, the buyer can pay the difference using the payment methods provided by the Site.
5. Prices and Shipping
The prices of the products include all taxes and duties. All prices are expressed in Euros.
- Shipping within Italy: Shipping is free throughout Italy for orders exceeding the amount indicated on the product sheet and in the cart.
- Shipping Abroad: Shipping abroad is subject to charges. For rates, consult the Shipping page.
6. Payment Methods
The Customer can pay the price of the Products and related delivery costs by credit card, PayPal, cash on delivery, or bank transfer.
Payment for Products purchased on the Site can be made by credit card directly through the Site. SPB shop accepts VISA, Mastercard, and Maestro credit cards. Accepted credit cards are, in any case, indicated in the footer of each page of the Site. The charge of the Total Amount Due by the user to SPB shop is made at the time of order transmission. To ensure the security of payments made on the Site and prevent fraud, SPB shop reserves the right to ask the user, via email, to send, through the same means, a front/back copy of their identity card and, if the order holder is different from the cardholder, the cardholder’s identity card. The document must be valid. The email request will specify the deadline by which the document must be received by SPB shop. This deadline will not, in any case, exceed 5 working days from the receipt of the request by the user. The order will be suspended pending the requested document. The user must send the requested documents within the indicated period.
If SPB shop does not receive these documents within the specified period in the email request or receives expired or invalid documents, the contract will be considered terminated by right pursuant to and for the purposes of art. 1456 of the Italian Civil Code, and the order consequently canceled, without prejudice to SPB shop’s right to compensation for any damage it may incur due to the user’s non-compliant behavior. The termination of the contract, of which the user will be informed via email, no later than 5 working days from the expiration of the period for sending the documents requested by SPB shop, will result in the cancellation of the order with a consequent refund of the Total Amount Due, if paid, by re-crediting the same payment method used. Upon timely receipt by SPB shop of the valid documentation requested, the delivery terms applicable to the order will start from the date of receipt of such documentation.
The confidential data of the credit card (card number, holder, expiry date, security code) are encrypted and transmitted to the payment manager. SPB shop never has access to or stores the credit card data used by the user for the payment of the Products.
PayPal
PayPal, an eBay group company, is a fast and secure payment system. Once this payment method is selected and “Confirm Order” is clicked, a window will open where you can choose between two options:
- Make the payment with your personal PayPal account;
- Pay with any credit/prepaid card (Visa, Visa Electron, Postepay, PayPal Card, Mastercard).
The system communicates directly with PayPal in complete security, so SPB shop never learns your payment method data. The amount will be charged directly to the credit card (Visa, Visa Electron, Postepay, Mastercard) or prepaid card (PostePay) you choose or associate with the PayPal account. You will receive a confirmation email from PayPal for each transaction. The order amount will be charged to the PayPal account when the order is acquired. If the order is canceled, the amount will be refunded to the PayPal account or credit/prepaid card.
If you have a card belonging to the American Express or Discover circuits, you can make the payment exclusively from the PayPal.com site.
Select PayPal or Credit Card as the payment method and, when the window opens, click the “Pay with PayPal” button; Once on the PayPal site, select “Don’t have a PayPal account?” and enter your American Express or Discover card details. Payment with PayPal or Credit Card speeds up order processing times, as the transaction is verified instantly and your order is immediately processed.
Cash on Delivery
With the Cash on Delivery method, you can pay in cash the exact amount of the order directly to the courier upon delivery. There will be an additional charge to the shipping cost, indicated in the order summary, which the courier retains for handling the money.
To facilitate product delivery procedures, ensure you have the exact amount available by verifying it in the order summary email, as couriers are not required to have the necessary change to provide the rest.
Bank Transfer
If you choose Bank Transfer as the payment method, you must make the transfer at the time of the order. The bank details for making the payment will be included in the order confirmation email. If you have not received the email, check the spam folder or contact customer service to request another copy.
Indicate in the transfer details the order number, your full name, and order date.
The order will be sent as soon as we receive the payment notification from the bank. Therefore, the order delivery times will be extended by the time it takes to receive payment confirmation.
SPB shop does not accept credit notes or bank drafts and reserves the right to request, in cases deemed appropriate, the payment of orders exclusively by bank transfer.
Order Processing and Shipping Times
Orders received will be processed as quickly as possible and shipped on the first business day after the order. Delivery times may vary depending on the availability of the ordered products, stock management, and the carrier used. Delivery times are provided in working days and are purely indicative.
Delivery in Italy: 1-3 working days Delivery in Europe: 3-7 working days Delivery outside Europe: 5-10 working days
Products are shipped by couriers specializing in transporting fragile goods. SPB shop is committed to shipping the ordered products, subject to availability, no later than 10 working days from the day of the order confirmation. SPB shop will not be responsible for any delivery delays caused by the courier.
7. Right of Withdrawal
The Customer has the right to withdraw from the contract, without indicating the reasons, within 14 days. The withdrawal period expires after 14 days from the day the Customer or a third party, other than the carrier and indicated by the Customer, acquires physical possession of the goods.
To exercise the right of withdrawal, the Customer must inform SPB shop of their decision to withdraw from this contract by an explicit declaration (e.g., a letter sent by post, fax, or email). The withdrawal form template may be used, but it is not mandatory. The Customer can also electronically fill in and send the withdrawal form or any other explicit declaration on the Site, using the contact form. If the Customer uses this option, SPB shop will promptly send an acknowledgment of receipt of such a withdrawal via email.
To comply with the withdrawal deadline, it is sufficient for the Customer to send the communication concerning the exercise of the right of withdrawal before the withdrawal period has expired.
If the Customer withdraws from this contract, all payments made to SPB shop will be refunded, including delivery costs (except for the additional costs resulting from the Customer’s choice of a delivery type other than the least expensive type of standard delivery offered by SPB shop), without undue delay and, in any event, no later than 14 days from the day SPB shop is informed about the Customer’s decision to withdraw from this contract. Such refunds will be made using the same payment method used for the initial transaction unless the Customer has expressly agreed otherwise. In any event, the Customer will not incur any fees as a result of such a refund. Refunds may be suspended until the goods are received or until the Customer has supplied evidence of having sent back the goods, whichever is the earliest.
The Customer must send back the goods or hand them over to SPB shop without undue delay and, in any event, no later than 14 days from the day on which they communicate their withdrawal from this contract. The deadline is met if the Customer sends back the goods before the period of 14 days has expired. The Customer will bear the direct cost of returning the goods.
The Customer is only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.
8. Legal Guarantee of Conformity
In case of conformity defects of Products sold by SPB shop, the Customer must immediately contact Customer Service using the appropriate contact form accessible via the “Support Area” or by writing an email to info@spb.it.
The sale of Products is subject to the legal guarantees provided for by articles 129, 130, and 132 of the Consumer Code. The Customer has the right, at their choice and provided the type of Product allows it, to restore the conformity of the Product through repair or replacement, without charge, or an appropriate reduction in the price or termination of the contract. The Customer loses these rights if they do not report the conformity defect to SPB shop within two months from the date they discovered the defect. In any case, actions aimed at asserting defects that are not intentionally concealed by SPB shop are prescribed within twenty-six months from the delivery of the goods.
9. Errors and Limitations of Liability
The information relating to the Products provided on the Site is constantly updated. However, it is not possible to guarantee the complete absence of errors, for which SPB shop cannot be held responsible, except in cases of willful misconduct or gross negligence.
SPB shop reserves the right to correct any errors, inaccuracies, or omissions even after an order has been sent, or to change or update the information at any time without prior notice, without prejudice to the Customer’s rights under these General Conditions and the Consumer Code.
Except in cases of willful misconduct or gross negligence, any Customer’s right to compensation for damages or the recognition of an indemnity is excluded, as well as any contractual or extra-contractual liability for direct or indirect damage to persons and/or things, caused by the non-acceptance or non-execution, even partial, of an order.
SPB shop promotes the responsible use of alcohol and excludes any liability at its expense, except in cases of willful misconduct or gross negligence, in the event of purchase made by minors under 18 years old.
10. Complaints
Any complaint must be sent to SPB shop using the appropriate contact form accessible directly on the Site via the “Support Area” or by writing an email to info@spb.it, or by registered letter with return receipt to the following address: SPB shop, Via Della Prava, 12, 21010, Cardano Al Campo VA. SPB shop undertakes to respond to all requests received within a maximum of 7 working days.
11. Applicable Law and Competent Court
The sales contract between the Customer and SPB shop is understood to be concluded in Italy and governed by Italian law. For the resolution of disputes arising from the interpretation, execution, or termination of these General Conditions or individual purchase orders, the court of the place of residence or domicile of the Customer will be competent, if located in the territory of the State.
The Court of Busto Arsizio will be competent for all other cases, notwithstanding the applicability of mandatory rules of law protecting consumers, which provide for the jurisdiction of the place of residence or domicile of the consumer.
